1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the AISoftware Design website and the software tools sold on it — AI Logo Maker, AI Website Builder, AI Graphic Designer, AI UI/UX Kit (together, the "Service"). By purchasing a license or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you accept these Terms on behalf of a company, you confirm you are authorized to bind that company.

2. The Service

AISoftware Design provides AI-powered design software that generates and edits logos, websites, graphic designs and user-interface (UI/UX) assets from text prompts and uploaded material. Each product is sold in several tiers ("Plans") that differ in usage limits, file formats, features and license rights, as described on the product page at the time of purchase.

3. Plans and Licenses

Every Plan is a one-time purchase. There is no subscription and no automatic renewal. After your payment is confirmed you receive a license key that activates the Plan you bought. Unless a Plan states otherwise:

• Entry / trial Plans (AI Logo Maker Free Trial, AI Graphic Designer Basic Pack, AI UI/UX Kit Starter Components, AI Website Builder Personal) are for evaluation and personal, non-commercial use. The AI Logo Maker Free Trial is valid for 7 days from activation and includes one PNG download.
• Standard paid Plans (e.g. Logo Maker Starter & Pro, Website Builder Business & Pro, Graphic Designer Standard & Pro, UI/UX Kit Full Library & Figma + Code Export) include a commercial-use license for your own business or clients' projects that you personally deliver.
• Usage limits are the quantities shown on the Plan, for example "10 logos", "5 websites", "25 websites" or "2,000 templates". A logo counts as used when you download its final files; a website counts as used while it is published.
• Agency Plans (AI Logo Maker Agency, AI Website Builder Unlimited Agency) additionally grant white-label rights — you may present the tool and its output under your own brand — and the right to sell the designs you create to your clients. You may not resell, sublicense or give access to the software itself, or your license key, to third parties.
• Team Plans (AI Graphic Designer Enterprise) include the number of user seats shown on the Plan. Each seat is for one named person and may be reassigned when someone leaves your team.
• Lifetime updates (AI UI/UX Kit Lifetime Updates + Support) means updates and new components for the AI UI/UX Kit for as long as we continue to develop and offer that product. "Lifetime" refers to the product's lifetime, not the buyer's.
• Buying a quantity greater than one gives you that number of separate licenses (for example, one per client or team member), each with its own key.
• Licenses are non-transferable except as described above. Sharing license keys or accounts outside of the rights of your Plan is prohibited.

4. Upgrades

You may upgrade to a higher Plan of the same product at any time. Contact support with your Order ID and we will credit the amount you already paid for that product toward the higher Plan.

5. Prices and Payments

Prices are shown in USD and are one-time amounts. The exact Plan and total are always displayed at checkout before you pay. Payments are processed by our payment partners (Stripe and Mollie); an order is complete only when the payment is confirmed. Any taxes that apply in your country may be added at checkout. We may change our prices at any time; price changes do not affect licenses already purchased.

6. Delivery

The Service is delivered digitally. Your license key is shown on your order page and emailed to the address you provide as soon as payment is confirmed — usually within seconds. If you have not received your key within 24 hours, contact support@aisoftware-design.com.

7. Refunds and Withdrawal

Because the Service is digital content supplied immediately, by completing your purchase you request immediate delivery and acknowledge that you lose the statutory right of withdrawal once your license has been delivered, where the law allows this. Our full refund rules are set out in the Refund Policy, which forms part of these Terms.

8. AI-Generated Output

• Ownership. As between you and us, you own the designs you create with the Service ("Output"), subject to your Plan's license rights and these Terms. We claim no ownership over your Output.
• Similarity. AI systems can produce output that is similar to output generated for other users or to existing works. We do not guarantee that Output is unique.
• Trademarks. We do not check whether a logo or brand name can be registered or is free of third-party rights. Before using a logo as a trademark, you are responsible for carrying out your own trademark search and, if needed, getting legal advice.
• Templates and assets. Templates, icons, fonts, components and stock elements supplied inside the tools remain our property or that of our licensors. You may use them as part of your Output but not redistribute them on their own (for example, as a template pack or UI kit).

9. Your Content

You keep all rights to the text, images, logos and other material you upload or enter into the Service ("Your Content"). You confirm you have the rights needed to use Your Content and give us a limited license to process it solely to provide the Service to you. We do not use Your Content to train AI models without your consent.

10. Websites and Custom Domains

For AI Website Builder Plans, you are responsible for the content published on your websites and for registering and renewing any custom domain you connect. We may remove or suspend a published site that breaks the law or these Terms.

11. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, or to create content that is illegal, defamatory, hateful, sexually explicit involving minors, or that infringes the rights of others;
• Copy or imitate the logos, trademarks or brand identity of another company in order to mislead people;
• Create phishing, scam or fraudulent websites or materials;
• Reverse engineer, decompile, resell or redistribute the software, or circumvent license restrictions or usage limits;
• Use automated means to extract templates, components or other assets in bulk;
• Interfere with or overload the Service's infrastructure.

12. Intellectual Property

The Service, including its software, AI models, templates, design system, website and branding, is owned by AISoftware Design and its licensors and is protected by intellectual property laws. Your purchase grants you a limited, non-exclusive license to use the software according to your Plan — nothing more.

13. Availability and Changes

We aim to keep the Service available at all times but do not guarantee uninterrupted operation. We may update, improve or change features. If we discontinue a product, we will give at least 30 days' notice and allow you to export your Output.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that Output will meet your requirements, be unique, be registrable as a trademark, or achieve any particular business result. Nothing in these Terms limits rights you have under mandatory consumer law.

15. Limitation of Liability

To the maximum extent permitted by law, AISoftware Design is not liable for any indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid for the Plan the claim relates to.

16. Indemnity

You agree to indemnify us against claims by third parties arising from Your Content, your Output as you use it, or your breach of these Terms.

17. Termination

We may suspend or terminate your license without refund if you materially breach these Terms — for example by sharing license keys, reselling the software, or unlawful use. Sections 8, 12, 14, 15 and 16 survive termination.

18. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows the latest version. The Terms in force when you bought a Plan continue to apply to that purchase for its core license rights.
